RESPA Foreclosure Violations: Real Estate Settlement Procedures Act Rights

The Real Estate Settlement Procedures Act (RESPA) is the most powerful federal law for foreclosure defense. It gives you three key weapons: (1) Notice of Error (NOE) — force the servicer to investigate and correct errors within 30 days, (2) Request for Information (RFI) — demand your loan documents, payment history, and servicing records, (3) Loss mitigation protections — Regulation X procedures that prohibit dual tracking and require fair evaluation. Each violation carries $4,000+ in statutory damages plus actual damages, costs, and attorney fees. At Dream Financial Management, we use RESPA violations as core foreclosure defense strategy nationwide since 1994.

RESPA Claims = Leverage Against Servicers

RESPA violations are the most common and easiest to prove in foreclosure defense. Servicers routinely: fail to respond to NOEs and RFIs, miscalculate loan balances, misapply payments, charge improper fees, and dual track. Each documented violation gives you a legal claim for $4,000+ plus attorney fees — creating leverage to demand loan modification, dismissal of foreclosure, or settlement.

How to Use RESPA in Foreclosure Defense

Step 1: Send Notice of Error (NOE)

Identify specific servicing errors: misapplied payments, incorrect fees, incorrect loan balance, failure to credit payments. Send via certified mail with return receipt. Servicer must acknowledge within 5 days and correct or explain within 30 days. Keep copies of everything.

Step 2: Send Request for Information (RFI)

Request: complete payment history, copy of original note and deed of trust, all servicing records, all loss mitigation evaluation records, and the identity of the note holder. Servicer must respond within 30 days. Use this to find more errors.

Step 3: File RESPA Lawsuit for Violations

If the servicer fails to respond correctly, you have a private right of action. Sue in federal court for: actual damages, statutory damages ($4,000 per violation), attorney fees, and costs. Use the lawsuit as leverage for loan resolution.
